Terms and Conditions: Transportation of Children Requiring Child Restraint Systems

These Terms and Conditions ("Terms") set forth the guidelines for the transportation of children requiring a child restraint system when using the Niagara Transit Plus app and services.

1. Purpose

These Terms establish guidelines regarding the transport of passengers traveling with children who require a child restraint system (meaning any child safety seat or booster seat used to secure a child in a motor vehicle), to facilitate compliance with applicable safety standards and applicable laws including but not limited to the Highway Traffic Act and its regulations, and to set out key passenger and operator responsibilities.

2. Passenger Responsibilities

By using the Niagara Transit Plus app and services for transportation with a child passenger requiring a child restraint system, you (the "Parent or Guardian") agree to the following:

  • Responsibility for Child Restraint System: You are exclusively and fully responsible for compliance with the laws applicable to transportation of a child accompanying you on any trip booked through the Niagara Transit Plus app. This responsibility includes bringing, installing, and securing a child restraint system for any child required to be secured in a child restraint system as defined by applicable Canadian federal and provincial laws and safety regulations, and in accordance with the manufacturer's instructions for the child restraint system or booster seat being used.
  • Compliance of Child Restraint System: The child restraint system or booster seat used by the Parent or Guardian must comply with all applicable Canadian federal and provincial laws and safety regulations. Operators are not obligated to verify compliance.
  • Operator Assistance: Operators are not permitted to assist with the installation or adjustment of any child restraint system under any circumstance.
  • Right to Decline Transportation: Operators may decline transportation if you are unable to install or secure the child passenger with the child restraint system. Exercising (or not exercising) this discretion does not impose any duty or obligation on the Operator to assess or determine the adequacy of the installation.

3. Operator Responsibilities

Operators are required to:

  • Allow access for a compliant child restraint system, provided the Parent or Guardian is installing the seat.
  • Inform the Parent or Guardian that the child restraint system must be installed without any assistance from the Operator.
  • Wait until the child is safely seated and secured and seek confirmation from the Parent or Guardian before beginning the scheduled trip.
  • Decline the trip if the Parent or Guardian has no child restraint system, is unable or refuses to install the child restraint system or the child is not properly secured within the child restraint system prior to proceeding with the trip, in the interest of passenger safety. Operators will file a report to their supervisor on duty and notify Niagara Transit.

4. Acceptance of Terms

By booking a ride involving a child requiring a child restraint system through the Niagara Transit Plus app, you acknowledge that you have read, understood, and agreed to these Terms.

Abandoned Rides

At Niagara Transit, we are committed to providing safe, reliable, and accessible Specialized Transit services. While it is rare, there may be occasions when a scheduled ride cannot be completed due to an unexpected issue. When this occurs, it is referred to as an abandoned ride.

What Is an Abandoned Ride?

An abandoned ride happens when a trip cannot be completed due to an unforeseen operational issue, such as a vehicle breakdown, mechanical issue, traffic accident, or a driver becoming unexpectedly unavailable. These situations prevent Niagara Transit from delivering the trip as planned.

While abandoned rides are uncommon, we treat every situation with urgency and care, working quickly to reduce the impact on the customer.

How Niagara Transit Responds

If an abandoned ride is identified, Niagara Transit takes several steps to minimize the disruption and support the affected customer:

  • Proactive Monitoring: Our team actively monitors upcoming trips in advance of their scheduled pickup times. This allows us to identify and respond to potential issues early, often before they affect the customer.
  • Timely Communication: We make every effort to contact customers promptly using the contact information we have on file.
  • Exploring Alternatives: As soon as we become aware of a potential issue, we will explore options such as reassigning the ride to another vehicle or working with alternate transportation providers to assist in completing the trip.
  • Follow-Up Support: If the trip cannot be completed, a member of our team will contact the customer to offer support and help reschedule if needed.

How Customers Can Help

To support a quick and effective response in the event of a disruption, customers are encouraged to:

  • Keep contact details up to date.
  • Please let us know as soon as possible if your plans change or if a ride needs to be cancelled.
  • Be ready at the scheduled pickup time and respond to any contact from Niagara Transit staff.
  • Ensure mobile devices are turned on and charged, so we can reach you if needed.

Why This Procedure Matters

By carefully managing abandoned rides, we help ensure fairness and efficiency in service across the region. It also allows us to make the best possible use of available vehicles and resources, so that all customers receive timely and reliable service.

Even when challenges arise, Niagara Transit remains committed to delivering responsive, respectful, and customer-focused service.

If you have any questions or need to update your contact information, please contact the Specialized Transit team directly. We’re here to help.
